The Unraveling of a Real Estate Mogul: Frédéric Merlin’s Latest Scandal

After stirring controversy with his management at BHV Marais and the highly debated arrival of Shein, Frédéric Merlin, president of Société des grands magasins (SGM), is now embroiled in a new affair, this time in Lyon. According to Le Canard enchaîné, Merlin is under investigation for unauthorized construction work on his classified villa, a property protected under heritage laws.

A Luxury Estate, Illegally Transformed

The accusations are substantial: a swimming pool, a 35 m² pool house, a terrace, renovated facades, and even felled trees are among the numerous luxury amenities allegedly added to the 1910 residence. This property, nestled within a classified wooded area, reportedly underwent these significant alterations without the necessary building permits, as detailed by the satirical weekly.

A Lingering Affair: Years of Non-Compliance

This is not a recent development. The matter dates back several years. Following five formal notices, municipal services finally confirmed the infractions during a visit in 2021, leading to an initial report to the public prosecutor’s office. In early 2025, Frédéric Merlin was informed that he could face prosecution for six offenses, with the possibility of the procedure being dropped if he restored the property to its original state within six months.

Continued Disregard for Regulations

However, regularization has been slow. A permit application was only submitted in January 2026. A subsequent inspection two months later revealed further unauthorized work. According to Le Canard enchaîné, agents noted a veranda encroaching on the classified wooded area and newly installed air conditioning units, prompting another referral to judicial authorities.

The Broader Context: A Pattern of Controversy?

This latest scandal adds to a controversial track record for Merlin. His tenure at BHV Marais was marked by significant changes, including the highly contentious introduction of the fast-fashion giant Shein, which drew both criticism and debate. The current accusations in Lyon, involving a disregard for local planning and heritage regulations, suggest a pattern of operating outside established norms.

What Lies Ahead?

The ongoing legal proceedings will determine the consequences for Frédéric Merlin. The repeated nature of the infractions and the high-profile status of the accused are likely to keep this case in the public eye, raising questions about accountability for those in positions of power and wealth. The city of Lyon, known for its rich architectural heritage, is left to grapple with the implications of such unauthorized developments on its protected sites.
